Project Profile – The client is seeking to develop the land to deliver 12 detached dwellings.

Site Sensitivities–Designated Green Belt.

Key Issues - This project is interesting and unique for the fact that we are using the planning process to challenge an existing Green Belt designation.  The land, which is a cultivated garden, was originally allocated to the Green Belt as part of a Local Plan review in 2005 without apparent evidence of any justification (contrary to policy) and against Inspector recommendation. Owing to time constraints, we cannot go behind the Plan to challenge the designation and so have reverted to the planning application process in the first instance as a means of highlighting the exceptional circumstances of the case.

Crowley Associates were initially appointed to research the legitimacy of the Green Belt designation.  Thereafter the client requested that we develop a strategy for challenging the local authority’s position.

We are currently appealing a refusal of planning permission and we are challenging the Green Belt designation through the Local Plan Inquiry process, working in partnership with DLA Piper in an effort to release the land.
